In the state of Virginia, garnishment laws are typical of many other states in that they are stricter than federal garnishment laws. Virginia law does allow creditors to garnish a debtor’s wages for repayment of debts. In most cases, the creditor will first be required to file a collection lawsuit against the debtor and obtain a money judgement.
