I doubt that it would be considered a probation violation any time soon. And, of course, you are less likely to receive any child support if he goes to jail for a probation violation.

Dec 22, 2011 · Unless the payment of child support was a condition to the probation, it should not be a violation. The failure to pay child support is a civil issue. To violate probation, you would need to either pick up a new criminal charge or violate a terms and condition of probation.

Jan 12, 2012 · Generally speaking, this would not be a violation for 2 reasons. #1, he is not on probation yet and the issue w/child support pre-dates his sentence of probation. #2, unless the probation judge makes child support a consdition of his probation, non-payment/arrears would not violate the terms.
