In that case, cash medical support is paid to the State of Ohio in order to defray the cost of such public assistance.
Since 2008, Ohio has had additional child support orders called “cash medical support orders”. These orders only come in to play when private health insurance is not available to the child who is the subject of the support order and/or the child is on Medicaid, Molina, Care Source or some other publicly funded health insurance.
The Ohio Revised Code continues to require all child support orders to order the obligor and/or obligee to obtain and/or maintain available private health insurance coverage that is reasonable in cost, and adds the requirement in all child support orders for the obligor to pay cash medical support during any period when the child is not covered by private health insurance as ordered in the support order.
Ohio law requires that all child support orders include both: 1) a child support payment amount when private health insurance is being provided, and 2) another amount for when health insurance is not provided. Each order must also include a cash medical support obligation.
Under Ohio law, either the obligor/non-custodial parent or obligee/custodial parent can be ordered to provide health insurance through a child support order. Employers can expect to receive a NMSN for their employees that are custodial and non-custodial parents depending on which party was ordered to provide coverage.
Will my child support order include medical support? Yes, Ohio law requires all child support orders to include a cash medical support obligation; an order for one or both parents to provide health insurance coverage for the child; and an order for both parents to share the cost of the child's remaining medical expenses.
(A) The child support enforcement agency (CSEA) shall calculate the cash medical support amount in accordance with this rule and with the Ohio child support guidelines as described in rule 5101:12-45-10 of the Administrative Code.
